Conditions of Use

Please read the following general Terms and Conditions ("Terms and Conditions") carefully, as the conditions included herein will govern your access to and use of our online platform, referred to as Approach. Approach co. owns this web portal. Approach is a web-based application (also known as "Application"). The application is an online platform that offers you the best Make-up services available. You can check out the application to see what services are accessible, the price list, different offers, and sample work from the greatest Makeup Artists. The application supports bookings for services, appointments, and gives booking reminders.By downloading or otherwise accessing the Application, you agree to be bound by the general Terms and Conditions set out below. There may be other features on the platform, and such particular features may have their own Terms and Conditions, which would also apply in the context of using the Application in addition to these Terms and Conditions.

GENERAL

Approach co. and/or its associates, associated parties, successors and assigns (collectively referred to as "Provider", "us", "we" or "our") own and manage the Application.


The following Terms and Conditions apply to:


  1. each person who accesses and downloads the Application ("Visitor"); and any person who provides the following information in any way for registering and offering their opinions:

  2. You must create an account, including a username and password, as part of the registration procedure. It is your responsibility to ensure that the information you supply is correct, does not mislead, and is relevant to you.

  3. If you suspect that your username and password have been leaked to or obtained by another party, please inform us immediately. Please keep in mind that we never contact users to ask them to validate their username, password, or other information.

  4. Third parties would not be given access to the User's personal information. but will be given the User's contact number if asked to confirm the appointment booking and make sure that the User's will arrive to the appointment in time.

  5. In these Terms and Conditions, users are referred to as "Users", "You" or "Your". You recognize and agree to be bound by the Terms & Conditions by becoming a User.

If You do not comply with our Terms and Conditions, we may suspend or terminate the Services. Using our Application and the different services we provide through it does not grant You any

Intellectual Property Rights in the Application or Services.


ACCOUNT SAFETY AND REGISTRATION ELIGIBILITY


In exchange for being a User, You represent and warrant that:


  1. You are at least 18 years old;

  2. You have the ability to make a legally binding contract;

  3. You are not a person forbidden from accessing or using the Software under the Terms and Conditions' governing laws;

  4. You are not in violation of any applicable law or regulation by accessing or using the Software.

  5. You shall keep Your contact information current and accurate. PAYMENTS

The User can make payments online through Knet. They can also pay in cash at the Service Provider once they have paid Approach co. their service cost.


APPOINTMENT CANCELLATION AND REFUND


User is required to cancel appointments for Service Provider's services at least three hours in advance, i.e., at least three hours before the scheduled time for appointment. This would allow the Service Provider to pursue alternative bookings. The amount paid in advance by the User will be kept as credit in the User's account for future appointments and services.


If the User cancels reservations in a hurry without allowing the Services Provider enough time to find alternative bookings, the User may be blacklisted from the Application.


ADVERTISEMENTS AND OTHER BUSINESS CONTENT


Advertising and other commercial or sponsored material would be attached to the Application for the benefit of the user and the advertisers, and they would be posted on the Website.


MAJEURE FORCE


Parties to the agreements will not be held liable for any failure or incorrect performance caused by a Force Majeure occurrence.


POLICY ON PRIVACY


Approach requires all Users to supply personal information such as their first and last name, email address, phone number/mobile number, and physical address, which is referred to collectively as Personal Information. All data is encrypted before being saved. We safeguard all Personal Information supplied to us in order to ensure Your security and confidentiality.


The User's information will only be revealed if required to do so by a legal obligation or a court of law.


LIABILITY EXCLUSION


You expressly acknowledge and agree that the Provider, its subsidiaries, and affiliates will not be liable to You for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from:


  1. accessing or being unable to access the Application, using or being unable to use the Application, all implicit warranties, Terms and Conditions applicable to the Application;

  2. any unauthorized access to or modification of Your communications or data, including any User Content; and

  3. Any warranty, terms, or conditions regarding the application's correctness, completeness, or quality.


WARRANTIES AND EXCLUSIONS


We utilize a commercially reasonable level of competence and care to protect the data submitted to us by the User, and we hope that our User enjoys using our Application. Though we maintain the highest accuracy standards in order to maintain our credibility, we make no guarantees concerning the content of the services, the specific functionalities of the services, or the suitability and reliability of the services to Your specific needs. We make no express or implied representations, warranties, or guarantees that our Services or any content on our site is accurate, comprehensive, up-to-date, or free of mistakes or omissions.


INDEMNITY


You undertake to completely indemnify, defend, and keep harmless the Provider and its subsidiaries or affiliates from any and all claims or demands, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, made by any third party owing to or arising out of Your:


access and use of the Application or any Application Contents thereof; breach of the Terms and Conditions; breach of privacy policy; or any of any other person's rights

To give more value to our Users, the Provider may provide, or third parties may provide, links to other websites or resources that You may access at Your sole discretion. Any reliance on the contents of a third-party website is done at Your own discretion, and You accept all responsibility and risk for the consequences of such reliance.


You understand and agree that the Provider has no control over these sites or resources. You understand and accept that we are not responsible for any information, material, goods, services, or advertising supplied by or through sites.


You also acknowledge and agree that the Provider is not responsible for the availability of such external sites or resources, and that the Provider does not endorse and is not responsible or liable for any content, advertising, products, services, or other materials on or available from such sites or resources.


You also acknowledge and agree that the Provider will not be liable, directly or indirectly, for any damage or loss caused or claimed to be caused by or in connection with the use of or reliance on any such content, products, or services accessible on or through any such site or resource.


NO THIRD PARTY BENEFITS


You agree that, except as specifically stated in these Terms and Conditions, there will be no third-party beneficiaries to these Terms and Conditions, and that You will not assign Your profile or registration to any other person.


NOTICES


Unless You expressly notify us differently, if You choose to supply us with a nominated email address, the Provider may communicate with You by sending You with notices about updates, changes, or additions to the Application or Services offered through or in conjunction with the Application.


COPYRIGHT


The Provider or its property holders own the copyright in any material contained on, in, or available via the Application, and You are obligated to abide by all copyright notices placed on the Application. The User is required to follow the copyright notices and is liable for any violations, and Approach expressly disclaims all liability in this regard.


MODIFICATIONS TO THE APPLICATION, CONTENT, AND TERMS AND CONDITIONS


The Provider maintains the right, at any time and from time to time, to change or discontinue the Application or any portion of it, temporarily or permanently, with or without notice to You. You agree that the Provider will not be liable to You or any third person if the Application or any portion of it is modified, suspended, or discontinued. All earlier versions of the Terms and Conditions are superseded by the most recent version posted on this website.


It is Your duty to check back on a frequent basis to see if a new version of the Terms and Conditions has been uploaded. If You do not agree to any adjustments as a result of the upload of a new version of the Terms and Conditions, You must stop using the Application immediately.

You agree that the Provider will not be liable to You or any other person as a result of any such modification, suspension, or discontinuation of the Application, as well as any revisions to the Terms and Conditions. Your continued use of the Application following such revisions or amendments shall indicate Your acceptance of the Terms and Conditions, as amended.

Approach co. has the right to make changes to the Terms and Conditions at any time and will be binding on the date of publication.


SEVERABILITY AND WAIVER OF TERMS


The Provider's omission to assert or enforce any right or provision of the Terms and Conditions shall not be construed as a waiver of that right or provision.


If a Court of competent jurisdiction rules that any provision of the Terms and Conditions is invalid, the parties agree that the Court should try to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms and Conditions will remain in full force and effect.


INFRINGEMENTS AND VIOLATIONS

GOVERNING LAW AND JURISDICTION


The Terms & Conditions will be legally enforceable. Any dispute or claim originating from the Terms and Conditions will be resolved in accordance with the laws of the State of Kuwait. You recognize, accept, and acknowledge that the Courts of the State of Kuwait have jurisdiction over any dispute arising in connection with the Terms and Conditions.


COMPLETE AGREEMENT


The Terms and Conditions supersede any earlier agreements between You and the Provider and govern Your access and use of, or purchase through or in conjunction with, the Application.


Additional terms and conditions may apply when You use or purchase some other Provider

services, related services, third-party content, or third-party software.
